MEDIA CONSENT AND RELEASE

OPTIONAL MEDIA AUTHORIZATION

Sound Bite Charters Ltd. loves capturing the moments that make a day on the water unforgettable -

from first catches and personal bests to breathtaking scenery and unexpected wildlife encounters.

With your permission, we'd love to share those memories with the world.

You are not required to authorize promotional media use to participate in a charter.

1. SCOPE OF AUTHORIZED MEDIA

If I select YES, I authorize Sound Bite Charters Ltd. to capture and use media that may include:

Photographs and video footage of me.
My voice and statements recorded during the charter.
Images of me fishing, holding or releasing fish, or participating in charter activities.
My first name, with any surname or other identifying information requiring additional consent.
My voluntarily provided testimonials or comments about the charter.
Group photographs and videos in which I am identifiable.

This authorization applies only to material obtained in connection with my Sound Bite Charters Ltd. experience.

2. PERMITTED PROMOTIONAL USES

Subject to the consent granted above, I authorize Sound Bite Charters Ltd. to use the media for:

The official Sound Bite Charters website.
Instagram, Facebook, YouTube, TikTok, and other official social media accounts.
Online charter listings and booking platforms.
Digital advertisements and promotional campaigns.
Printed marketing materials, brochures, and promotional displays.
Company portfolios, presentations, and promotional reels.
Media features or publicity directly related to Sound Bite Charters Ltd.

The Operator may permit its contracted photographers, videographers, marketing professionals, and advertising service providers to process the media on its behalf for these purposes, subject to appropriate privacy and contractual safeguards.

3. EDITING AND PRESENTATION

I understand that authorized media may be edited for reasonable promotional purposes, including:

Cropping, resizing, and colour correction.
Adding company logos, graphics, captions, and music.
Combining footage into promotional reels or advertisements.
Formatting media for different websites and social media platforms.

Sound Bite Charters Ltd. agrees not to knowingly edit or present my likeness in a materially false, defamatory, degrading, or misleading manner.

This authorization does not permit the creation of deceptive AI-generated statements or synthetic endorsements attributed to me.

4. OWNERSHIP AND COPYRIGHT

I understand that photographs and recordings created by Sound Bite Charters Ltd. or its authorized content creators may be protected by copyright.

This media consent does not transfer copyright in photographs or recordings that I personally create.

If I independently provide photographs or videos to Sound Bite Charters Ltd., a separate licence or written permission may be required for promotional use.

5. COMPENSATION

I understand that I will not receive payment, royalties, or other compensation solely because Sound Bite Charters Ltd. uses authorized media for the promotional purposes described in this agreement.

This provision does not prevent the parties from entering into a separate paid content, licensing, or endorsement agreement.

6. DURATION AND WITHDRAWAL OF CONSENT

This authorization takes effect on the date I sign and continues unless I withdraw it.

I may withdraw my consent for future promotional use by sending a written request to Sound Bite Charters Ltd. using its published contact information or designated privacy contact.

Following withdrawal, Sound Bite Charters Ltd. will stop new promotional uses of my identifiable media and take reasonable steps to remove it from company-controlled digital channels, subject to applicable legal requirements.

I understand that withdrawal may not result in the removal of material already distributed, printed, independently shared, or retained by third-party platforms beyond the Operator's reasonable control.

Any continuing use or retention following withdrawal must have a lawful basis.

7. PRIVACY AND PERSONAL INFORMATION

I understand that identifiable photographs, recordings, and my voice may constitute personal information under applicable privacy legislation.

Sound Bite Charters Ltd. will collect, use, disclose, retain, and protect this information in accordance with applicable law and its privacy policy.

I understand that publishing authorized media online may make it accessible outside Canada and that third-party platforms may have their own privacy practices.

Sound Bite Charters Ltd. will not sell my identifiable media to unrelated third parties for independent advertising campaigns without obtaining separate permission.

8. LIMITATION OF RELEASE

To the extent permitted by applicable law, I authorize the specific promotional uses described in this agreement and agree not to assert claims based solely on uses that are within the scope of my valid consent.

This agreement does not release Sound Bite Charters Ltd. from liability for unauthorized use, misuse of personal information, defamatory or misleading publication, or other liability that cannot lawfully be excluded.

This agreement is separate from the passenger safety agreement and does not affect my rights concerning personal injury or marine transportation.

9. ADULT PARTICIPANT SIGNATURE

I confirm that:

I am at least 19 years old.
I understand the media consent choices.
I have voluntarily selected my preference.
I understand how my media may be used if I consent.
I understand that I may withdraw consent as described above.
I understand that refusing consent does not affect my charter experience.

10. MINOR PARTICIPANT MEDIA CONSENT

Complete this section only if the person being photographed or recorded is under 19 years of age.

Additional Child Privacy Protections

Sound Bite Charters Ltd. will not intentionally publish the minor's full legal name, date of birth, home address, school, or other sensitive identifying information without separate, specific, lawful authorization.

The Operator will respect any refusal or objection expressed by a minor who is capable of understanding the proposed recording or use.

This consent does not waive the minor's independent privacy or other legal rights.
