SOUND BITE CHARTERS LTD.

PASSENGER RISK ACKNOWLEDGMENT,

SAFETY AGREEMENT & CONSENT TO PARTICIPATE

Vessel: SOUND BITE 1

Captain / Master: NOAH-PRYCE-JONES

Bowen Island, British Columbia, Canada

1. DESCRIPTION OF ACTIVITIES

I understand that Sound Bite Charters Ltd. (the "Operator") provides guided recreational fishing and sightseeing experiences aboard a commercially operated vessel in coastal waters around Bowen Island, British Columbia, and surrounding authorized fishing areas.

Activities may include boarding and disembarking, navigating coastal waters, operating fishing equipment under crew supervision, handling fish, observing marine wildlife, and travelling in variable weather and sea conditions.

Participation in fishing is optional. All passengers, including non-anglers, must comply with vessel safety requirements.

2. ACKNOWLEDGMENT OF RISKS

I acknowledge that recreational boating and fishing involve inherent hazards that may cause injury, illness, property loss, permanent disability, or death.

These hazards may include:

  • Slippery decks, boarding surfaces, docks, and ladders.

  • Sudden vessel movement, wakes, waves, swells, and turbulence.

  • Falling, slipping, tripping, or falling overboard.

  • Cold-water immersion, drowning, and hypothermia.

  • Sudden changes in weather, tides, visibility, or sea conditions.

  • Fishing hooks, knives, lines, downriggers, rods, reels, and other equipment.

  • Injuries caused by fish or marine wildlife.

  • Seasickness, dehydration, fatigue, and exposure to the elements.

  • Mechanical failures, collisions, groundings, or other marine emergencies.

  • Delayed access to emergency services or medical treatment.

  • Actions of other passengers or third parties.

I understand that reasonable safety precautions cannot eliminate every inherent risk.

3. VOLUNTARY PARTICIPATION AND LEGAL RIGHTS

I voluntarily elect to participate in the charter with knowledge of the risks described in this agreement.

I agree to exercise reasonable care for my own safety and to follow all lawful and reasonable instructions provided by the captain and crew.

I understand that participation does not guarantee calm seas, favourable weather, successful fishing, or wildlife sightings.

Nothing in this agreement releases Sound Bite Charters Ltd., its captain, crew, or other persons from liability for negligence, personal injury, death, or property loss where such liability cannot lawfully be excluded.

Nothing in this agreement limits or removes any mandatory right or remedy under the Marine Liability Act, applicable Canadian maritime law, or other applicable legislation.

4. CAPTAIN'S AUTHORITY AND PASSENGER CONDUCT

I acknowledge that the captain has operational command of the vessel and is responsible for making navigational and safety decisions.

I agree to:

  • Attend and follow the pre-departure safety briefing.

  • Follow instructions regarding seating, movement, boarding, and disembarking.

  • Use lifejackets or personal flotation devices when required.

  • Remain within designated passenger areas.

  • Refrain from interfering with navigation, emergency, or safety equipment.

  • Avoid reckless, threatening, or unsafe behaviour.

  • Notify the crew immediately of unsafe conditions, injuries, or emergencies.

The captain may alter the route, fishing location, activities, or trip duration when reasonably necessary for safety, legal compliance, or operational circumstances.

The captain may refuse or discontinue participation by a passenger whose conduct creates a material safety risk, subject to applicable law.

5. HEALTH AND EMERGENCY INFORMATION

I understand that medical assistance may be delayed while the vessel is at sea.

I agree to advise the captain privately of any medical condition, severe allergy, mobility limitation, or other circumstance that could materially affect my safety or require emergency assistance.

I am responsible for bringing medications and personal medical supplies that I may reasonably require during the charter.

I understand that the Operator may use necessary emergency information to arrange assistance when required.

Personal health information will be handled in accordance with applicable privacy law.

6. ALCOHOL, DRUGS, AND IMPAIRMENT

I agree not to participate while impaired to a degree that compromises my safety or the safety of others.

I will not use or possess unlawful substances aboard the vessel.

The captain may restrict or terminate participation when impairment or conduct creates a safety concern.

Any financial consequences of removal or early termination are governed by the booking agreement and applicable law.

7. FISHING LICENCES AND REGULATIONS

Passengers who participate in fishing must comply with all applicable federal and provincial requirements.

I acknowledge that:

  • An appropriate valid B.C. Tidal Waters Sport Fishing Licence is required for each person fishing, including minors.

  • A salmon conservation stamp is required where applicable.

  • Species-specific limits, minimum and maximum sizes, area closures, retention restrictions, and catch-recording requirements may apply.

  • Fisheries regulations may change before or during a charter.

  • The captain may require the release of fish to comply with applicable laws.

  • Fish retention is not guaranteed.

I agree to provide required licence information and cooperate with lawful fisheries inspections.

8. MARINE WILDLIFE AND ENVIRONMENTAL PROTECTION

I understand that marine wildlife may be encountered during the charter, including whales, dolphins, porpoises, seals, sea lions, and seabirds.

I agree not to feed, touch, pursue, disturb, or harass marine wildlife.

I will comply with crew instructions regarding wildlife viewing, vessel movement, fishing restrictions, and environmental protection.

I understand that wildlife sightings are not guaranteed and that wildlife protection requirements take precedence over recreational activities.

9. FISHING EQUIPMENT AND CATCH HANDLING

I agree to use fishing equipment only as instructed or authorized by the crew.

I will exercise care around hooks, knives, fishing lines, weighted equipment, and moving mechanical components.

I understand that the captain and crew may control the handling, release, retention, cleaning, and filleting of fish.

All catch handling and retention must comply with applicable fisheries regulations.

10. PERSONAL BELONGINGS

I understand that personal belongings may be exposed to saltwater, weather, vessel movement, and accidental

loss or damage.

I agree to take reasonable precautions to secure my belongings.

The Operator's liability for luggage and personal property remains subject to applicable Canadian maritime law and other mandatory legal requirements.

11. EMERGENCY PROCEDURES AND MEDICAL ASSISTANCE

In an emergency, I authorize the captain and crew to seek appropriate emergency assistance and to provide reasonable first aid within their training and authority.

If I am unable to provide informed consent, I acknowledge that emergency treatment may be arranged in accordance with applicable law.

I understand that emergency response, evacuation, or medical treatment may involve third-party services.

This provision does not override my legal rights concerning consent to medical treatment.

12. WEATHER, CANCELLATIONS, AND MODIFICATIONS

I understand that weather, sea conditions, mechanical issues, safety concerns, and regulatory restrictions may require the Operator to delay, modify, shorten, reschedule, or cancel a charter.

Any entitlement to a refund, credit, or rescheduling will be determined under the separate Sound Bite Charters Ltd. Booking and Cancellation Policy, subject to applicable law.

13. MINOR PASSENGERS

Passengers under 19 years of age must have appropriate parental or legal guardian authorization.

Parents and guardians are responsible for supervising minors in their care, without reducing the Operator's own legal safety obligations.

Minors must comply with all applicable vessel safety requirements.

A separate parent or legal guardian consent form must be completed for each minor passenger.

No provision of this agreement is intended to waive a minor's independent legal rights where such waiver is not permitted.

14. PRIVACY AND PERSONAL INFORMATION

Sound Bite Charters Ltd. collects and uses passenger information as reasonably necessary for booking administration, passenger safety, emergency response, regulatory compliance, and lawful business operations.

Personal information will be handled in accordance with applicable Canadian privacy legislation and the Operator's privacy policy.

Promotional photography and video consent will be requested separately.

Declining promotional media consent will not prevent participation in the charter.

15. GOVERNING LAW

This agreement is governed by applicable Canadian maritime law and, where applicable and not inconsistent with federal law, the laws of British Columbia.

Disputes arising from this agreement will be determined by a court of competent jurisdiction.

If any provision is found unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

By signing, I confirm that:
